New Senior Investment Group, Inc.

On June 8, 2017, Plaintiff John Cumming, on behalf of himself and New Senior Investment Group, Inc. filed an amended derivative complaint in the Delaware Chancery Court against certain members of the Board of Directors of New Senior, Fortress Investment Group, LLC and four Fortress affiliates, for breach of fiduciary duty, and aiding and abetting the same, in connection with the acquisition by New Senior, on June 22, 2015, of a portfolio of 28 senior-living properties from a company owned by one of Fortress’s private equity funds, on unfair terms and for an inflated price.
